This would be considered an alteration, or expansion of the current use and would require a zoning certificate, a COA obtained by the DRB for alterations, and the need for a conditional use permit. Reference Chapter #1157.03 (d), 1157.04, 1127.01, 1187.06, of the city’s Codified Ordinance.

Per Chapter 1181.06 of the code, nonconforming uses are not to be expanded, except when allowed to do so by law, etc. Self-service car washes may be permitted if a Conditional Use Permit (CUP) is requested and ultimately approved. Based on this information, my opinion is that the only way a reconstruction, or alteration of this use could be considered is via an application being submitted by the property owner (or business owner with landowner permission) to allow the use and the proposed expansions. There can be no expansion without a CUP, nonconforming uses are not allowed to be expanded by right.
